This Content Removal Policy ("Policy") governs the submission, review, and processing of requests to remove or modify Content made available by Kallfi across our website and related services (collectively, the "Services").
By accessing or using the Services, you agree to the procedures outlined in this Policy, which forms an integral part of our Terms of Service ("Terms") and Privacy Notice (collectively, the "Policies"). Capitalized terms not defined herein have the meanings given in the Terms.
1. Prohibited Content Categories
We maintain a zero-tolerance policy for illegal, non-consensual, or harmful Content. The categories of Prohibited Content set forth in the Terms will be removed expeditiously upon identification or notice and may result in immediate Account termination and reporting to law enforcement. Prohibited Content includes, without limitation:
- Child Sexual Abuse Material (CSAM): Any content depicting, simulating, or suggesting minors (under 18 years of age) in sexual, suggestive, or exploitative contexts. This includes AI-generated imagery. Such content will be reported to NCMEC (National Center for Missing & Exploited Children) and relevant law enforcement authorities.
- Non-Consensual Intimate Imagery (NCII) / Deepfakes: Any AI-generated or synthetic nude, intimate, or sexually explicit image, video, or audio depicting a real, identifiable person including so-called "deepfakes." This prohibition extends to content that is disclosed or threatened to be disclosed with intent to harass, intimidate, or harm.
- Unauthorized Likeness or Personal Data: Generative prompts or outputs that use the real name, biometric features, voiceprint, or private personal data of any individual other than you.
- Intellectual Property Infringement: Content that infringes third-party copyrights, trademarks, publicity rights, or proprietary rights.
- Extreme Violence, Hate Speech, & Harassment: Content that promotes self-harm, hate speech, illegal acts, severe violence, or non-consensual sexual violence.
- Terrorism and Violent Extremism: Content that promotes, incites, or glorifies terrorism, violent extremism, or the activities of designated terrorist organizations.
2. How to Submit a Content Removal Request
If you believe that Content on our Services violates this Policy, infringes your rights, or depicts you or someone you legally represent without consent, you may submit a Content Removal Request through:
- Web Notice Form: Available via the Report Content.
- Email: Compliance@kallfi.com.
In order to ensure accuracy and legitimacy of the content removal we may require the User to provide certain information, including but not limited to:
- A detailed explanation of why the Content should be removed (e.g., non-consensual likeness, copyright infringement, privacy violation, CSAM concern).
- Proof of identity of the User or their relationship to the reported Content.
- For copyright infringement claims under the Digital Millennium Copyright Act (DMCA), the notice must include the requested information detailed within our DMCA Notice.
If a submission lacks sufficient detail to verify identity or locate the Content, we may request additional information.
3. Content Removal Process
When a Content Removal Request is verified and upheld, we take the following corrective steps:
We will acknowledge receipt of valid removal requests without undue delay. For manifestly illegal content, we will remove or disable access expeditiously upon verification. Complex cases requiring additional investigation will be resolved in a timely manner.
Where required under applicable laws, we will provide you with a statement of reasons for any decision to remove Content, restrict visibility, or take action against your Account, including the grounds for our decision and information about available redress options, where we have your electronic contact details.
4. Appeal Procedure
If a User or Content Creator believes their Content was removed in error, they may lodge a complaint within six (6) months of our decision. Complaints should include: (i) the original removal notice reference; (ii) a statement explaining why the decision was incorrect; and (iii) any supporting evidence. We will review complaints under human review in a non-discriminatory, diligent, and timely manner, and provide a reasoned decision. We may reverse a previous decision where the complaint demonstrates that the Content did not violate applicable law, third-party rights, or the Terms. For DMCA counter-notifications, the process set forth in the DMCA Notice applies.
Users in the European Union may also refer disputes to a certified out-of-court dispute settlement body, or seek judicial redress in accordance with applicable law.
You agree not to abuse or misuse our reporting or complaint mechanisms. Misuse includes repeatedly submitting manifestly unfounded notices or complaints, submitting reports lacking sufficient information, or using these mechanisms for harassment or malicious purposes. Where you misuse these mechanisms, we may, after a warning where legally required, suspend your ability to use them.
5. Confidentiality and Data Protection
All personal information submitted during the content removal process will be processed in accordance with our Privacy Policy and your personal data will be retained only as long as necessary to process the request, maintain required records, and comply with our legal obligations. We will not disclose complainant identity to the content uploader except where legally required or necessary to resolve the claim.
6. Repeat Infringer Policy
We reserve the right to terminate, in appropriate circumstances, the Accounts of Users who repeatedly infringe intellectual property rights or who repeatedly violate the Terms, this Policy, or any of our other Policies.
7. Law Enforcement Cooperation
You acknowledge and agree that Kallfi has the right to fully cooperate with any law enforcement authority or court order requesting or directing us to disclose the identity or other information of anyone posting any Content on the Services, and you release Kallfi from any liability associated with such disclosure to the extent permitted by law.
8. Transparency
In accordance with our obligations under the Digital Services Act (EU) 2022/2065 and the UK Online Safety Act 2023, we shall publish an annual transparency report. To request a copy of the most recent transparency report, please contact us using the details in the "Contact Us" section of our website.
